Kasey Grant Killed, Teen Injured in Helena-West Helena Gas Station Shooting

Kasey Grant Killed, Teen Injured in Helena-West Helena Gas Station Shooting (WREG)

Did negligent security contribute to this tragic loss of life and are justice and compensation available to Mr. Grant’s family?

LOCAL NEWS

Gunfire erupted outside a Helena-West Helena gas station Tuesday morning, January 22, 2019, claiming the life 25-year-old Kasey Grant and leaving a teenage boy injured.

According to WREG 3, Mr. Grant and his teenage passenger were shot “as they sat parked at a gas pump at the Victory Fuels gas station in the 500 block of Columbia,” around 7:30 a.m. Mr. Grant was taken to Helena Regional Medical Center, where he succumbed to fatal injuries.

Police told FOX 13, the 17-year-old victim was transported to the hospital with “non-critical” injuries.

OUR LEGAL TAKE

Gas station patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided at the gas station and whether this tragedy may have been prevented.

  • Have there been prior incidents of violence on or near property?
  • What security measures, such as bright lighting, monitored surveillance cameras, clear windows, and visible security personnel, were in place to deter crime and protect Mr. Grant and the surviving victim at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the gas station owner failed to provide adequate security to protect those on its premises, Kasey Grant’s family may seek justice and elect to pursue legal claims for their loss. Additionally, the surviving young victim may pursue legal claims for his injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Selecting the right attorney for you or your family is highly important. You must feel confident that the attorney you hire has a complete understanding of the law applicable to your particular case, and has successful experience in handling such cases.

Important: Do not hire a lawyer who has violated the Rules of Professional Conduct!!!

You should not hire an attorney who calls you or visits you unsolicited, or anyone that contacts you directly to offer legal services. This activity is strictly prohibited by Rule 7.3 of the American Bar Association (ABA) Model Rules of Professional Conduct, which states as follows:

ABA Center for Professional ResponsibilityA LAWYER “SHALL NOT” CONTACT A PROSPECTIVE CLIENT THROUGH A “LIVE TELEPHONE” OR AN “IN-PERSON” VISIT.

– RULE 7.3, ABA MODEL RULES OF PROFESSIONAL CONDUCT.

If an attorney, or someone acting on behalf of an attorney, contacts you in this manner, that attorney is in violation of this Rule. This unethical and unprofessional activity on the part of the lawyer is good sign that you should stay away. It is imperative that you are represented by an attorney who is capable of advocating for you within the confines of the law, and an attorney who fails to abide by the Rules of Professional Conduct is probably not the best fit. In fact, any such attorney should be immediately reported to the local State Bar Association. If you have been contacted in such an unsolicited manner, contact us and we’ll assist you in filing a report.

A Memphis woman was recently robbed at gunpoint outside a gas station, in what WREG describes as a “growing gas station trend.” The thief apparently “pretended to get gas next to her…but then grabbed her purse and aimed a gun when she tried to get it back.” Police told media “gas stations have become hot spots for these types of crimes.”

Unfortunately, these thieves often take more than money and property. A store clerk was shot and critically injured during a Memphis gas station robbery in July 2018, per WREG reports. A 26-year-old man was shot and critically injured during an attempted carjacking outside a “gas station” in Hickory Hill in July 2015, per WMC 5 reports.

Gas stations are often targets for criminal activity due to (frequently) late hours of operation, accessibility to major roadways, and vulnerable patrons. Memphis police urge gas station patrons to stay alert and follow these safety guidelines at the pump:

  • Don’t keep your valuables in your car.
  • Carry your purse.
  • Don’t leave keys in the ignition.
  • Make sure your doors are locked.
  • Use a towel the same color as your car’s interior to hide belongings if you must keep them in your car.

Victims of Tennessee Gas Station Violence: Know Your Rights

Tennessee gas station patrons have a right to feel safe and secure while on the premises of the establishment they are visiting. By law, business owners are required to protect all patrons legally on the premises from any foreseeable harm. For example, should a gas station owner have knowledge of prior violence on or near property, they have a responsibility to implement additional security precautions to protect patrons and deter such crime. Additional security measures may include bright lighting, a security guard or off-duty police officer, surveillance cameras, and bulletproof pass-through windows for cash transactions. Should a gas station owner or manager fail in this critical responsibility, they may be held civilly liable for any injuries or wrongful deaths which occur as a consequence.

An argument outside Kelley’s Market gas station in Madison reportedly escalated into gunfire early Sunday morning, May 27, 2018. Thankfully, The Wisconsin State Journal reports, nobody was harmed during the shooting. However, the incident raises grave concerns over security and safety measures at Madison area gas stations.

Gas stations are often targets for criminal activity due to (frequently) late hours of operation, accessibility to major roadways, and vulnerable patrons. The National Crime Prevention Council urges patrons to reduce their risk of becoming victims by taking the following safety precautions:

  • Pick stations that are well-lit and have video surveillance cameras at the pump.
  • Always remove your keys and lock the doors while you are pumping gas.
  • Keep valuables out of plain view in your vehicle and lock the doors even if you are going inside for a moment.
  • Pay attention to your surroundings.
  • Don’t let your cell phone distract you.
