Motel guests and visitors have a right to feel safe and secure while on the premises. The level of security provided at the motel is of significance, and is a relevant consideration when analyzing whether this shooting may have been prevented.  The following questions are also important in assessing whether this incident may have been avoided:

  • What protocol was in place to deter crime and protect the victims at the time of the shooting?
  • Was the property owner or manager aware of any suspicious persons or suspicious activity on the property prior to the shooting?

  3. Was the tragedy a result of a catastrophic equipment malfunction?
  4. What was the condition of any machinery/equipment involved?
  5. Was the company or property owner aware of the potential safety risks to employees?
  6. If equipment or machinery were involved in the incident, were any attempts made to service, recall or replace any such machinery or equipment prior to the incident?

Washington, MO NEWS – An apartment fire Sunday afternoon, January 19, 2025, tragically claimed one life.

As reported by KSDK.com, “dispatchers received a 911 call from a woman reporting her apartment on fire at about 3:04 a.m. Monday…The first officer arrived at the scene at about 3:05 a.m. Monday at the apartments at 320 Jefferson St.”

According to the report, “[t]he Washington Fire Department arrived at the scene at about 3:11 a.m. and began a rescue operation. Firefighters located the two women inside the apartment, but both [were unable to survive the incident].”

EMissourian.com is reporting, “Sharon Pepmueller, 72, and her daughter, Amber Pepmueller, 42, were [the victims of the fire]. Sitzes said the women lived together in a second-floor apartment. They were the only two occupants of the building during the fire.”

The news report states, “the apartment the women lived in did have working smoke alarms, but initial findings on the scene indicated doors left open may have allowed large amounts of smoke to enter the apartment.  ‘There was a lot of fuel in the back of that building, with trash cans. So we think it started on the outside and worked its way in.'”

Fire inspectors continue to investigate the cause of the fire.

FORMER CLIENT: I had lawyers calling me, and friends telling me who I should hire…I trusted in The Murray Law Firm and I’m glad I did.

As authorities continue their investigation, premises liability attorneys with The Murray Law Firm question whether a lack of security or fire safety measures at the complex may have contributed to this incident.

  • What fire safety measures, such as working smoke detectors, fire sprinklers and emergency exits, were in place and working at the time of the fire?
  • When was the last fire inspection performed on the property?
  • Were any safety measures added after any previous inspections?
  • Was the property owner aware of any inadequate fire safety measures present prior to the fire?

As details of this fire continue to emerge, The Murray Law Firm suggests that it is possible that the apartment complex failed to undertake proper safety measures to protect those residents and guests legally on the premises. Under certain State law, the owner and management company of an apartment complex have a duty to protect residents and to keep the premises safe. If the owner or manager fails in this duty, they may be held civilly liable for any injuries or wrongful deaths that occur as a consequence.  Should the apartment complex be found at fault, the family of Sharon Pepmueller and Amber Pepmueller may elect to hold the owner and management company civilly liable for their loss and suffering.

As insurance companies and unscrupulous property owners are often concerned with limiting their financial exposure in these incidents, it is crucial that the family of Sharon Pepmueller and Amber Pepmueller retain an experienced premises liability firm as soon as possible to ensure all evidence, such as a faulty fire alarm or a poor evacuation plan, is preserved and the family’s best interests are protected. The Murray Law Firm has extensive experience in premises liability and apartment negligence cases, such as this, and we offer our legal expertise, if needed.

KPLCtv.com is reporting, “[a] witness said he was sitting in his car outside the apartments, where he was visiting his brother, when people threw snowballs at a car. The driver got out, flashed a gun, then drove to the back of the complex. After a couple minutes, the driver returned with his lights off and turned south onto Pecan Acres before turning around and driving north in front of the complex, where he stopped, got out and fired in the area of the snowball throwers. One bullet went through a sliding glass door of a balcony facing the street, while another traveled through the breezeway of the building on the street and into a second-story window of the next building, in which Lebleu lived.”

According to KPLCtv.com, “[t]his is the third shooting at [the] Apartments in five months. The first shooting happened on Sept. 8 and left a 19-year-old man dead and injured a teenage bystander on Sept. 8. The second shooting happened on Dec. 29, and left one person dead and another injured.”

The investigation is ongoing.

FORMER CLIENT: I had lawyers calling me, and friends telling me who I should hire…I trusted in The Murray Law Firm and I’m glad I did.

Apartment complex residents and guests have a right to feel safe and secure while on the premises they are visiting. The level of security provided at the property is of significance, and is a relevant consideration when analyzing whether this shooting may have been prevented.

The following list of questions are also important in assessing whether this incident may have been avoided:

  • Have prior incidents of violence been reported on or near the property?
  • Was the property owner or manager aware of any suspicious activity prior to the shooting?
  • Were any security personnel at the property?
  • Were security measures added after any prior incidents?
  • What protocol was in place to deter crime and protect the victims at the time of the shooting?
  • Have authorities been to the property on prior occasions?

Property owners are generally required to protect against foreseeable harm to anyone and everyone legally on the premises.  Should the investigation into this incident reveal facts that establish that the property owner or management lacked adequate security to protect its visitors, the family of Tyler LeBleu may seek justice and elect to pursue legal claims and substantial compensation for their loss.

The Murray Law Firm has extensive and successful experience in handling security negligence claims on behalf of victims and their families, and suggests that an immediate, unbiased inspection of the property will need to be performed so as to limit evidence from being altered, damaged or destroyed.  The complexities of pursuing a negligent security case are well understood by the legal team at The Murray Law Firm, and it is imperative that the family of Tyler LeBleu retain a capable law firm who will work without delay to protect their interests.

If an attorney, or someone acting on behalf of an attorney, contacts an injured victim in person or via telephone withoutUnsolicited-From-Lawyer-300x149solicitation, that attorney is in violation of Rule 7.3 of the ABA Model Rules of Professional Conduct.  This Rule has been adopted by most states, and some states go further to prohibit or limit contact by attorneys via methods such as mail or e-mail.  Unethical and unprofessional solicitation by an attorney or their representative is likely a good sign that an injured victim should stay away from that attorney.  An injured victim should seek to be represented by an attorney who is capable of advocating within the confines of the law, and an attorney who fails to abide by the Rules of Professional Conduct is probably not the best fit.  In fact, any such attorney should be immediately reported to the local State Bar Association.
