Did negligent security contribute to the tragic loss of this young man and are justice and compensation available to the young victim’s family?

Local News

According to The Commercial Appeal, gunfire erupted “at the Peppertree Apartments…on Graceland Drive” Wednesday morning, November 14, 2018, claiming the life of an 18-year-old man.

The tragedy raises grave questions over security measures at the complex, which has an extensive “history of problems,” per WREG reports. “In 2015, MPD reported 1,000 calls from murders to drugs.”

 Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided at the apartment complex and whether this tragedy may have been prevented.

  • How did the shooter(s) gain entry to the complex?
  • What additional security measures, such as gated and guarded entry, fencing, bright lighting, monitored surveillance cameras, tenant background checks, and visible security patrols, were implemented by the apartment complex owner following media reports of prior violence on property?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner failed to provide adequate security to protect those on its premises, the young victim’s family may seek justice and elect to pursue legal claims for their loss.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Could the senseless shooting of a pregnant Memphis woman have been prevented and are justice and compensation available to Ms. Jackson and her newborn son?

Local News

Three weeks after giving birth to a healthy son, Memphis mother Alexes Jackson speaks out on the violent apartment home invasion she survived while pregnant.

According to FOX 13, an assailant broke into Ms. Jackson’s home “at the Legacy at the Parkway” apartment complex, “took her cellphone, shot her, and left in a white Mercedes vehicle.”

Ms. Jackson told police she “started knocking on doors and screaming for help, but nobody answered,” per FOX 13 reports. “She ran a mile to a friend’s apartment in the 3100 block of Ridgeway, which is where she called 911.”

The harrowing ordeal raises grave questions over security measures at the complex.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this unconscionable shooting may have been prevented.

  • What security measures, such as gated-entry, fencing, bright lighting, surveillance cameras, and security patrols, were in place to deter crime and protect Ms. Jackson at the time of the shooting?
  • Where was apartment security and management as the pregnant victim ran through the complex screaming for help?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner failed to provide adequate security to protect those on its premises, Alexes Jackson may seek justice and elect to pursue legal claims for her injuries and any injuries suffered by her infant son.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Could the unconscionable shooting of this Memphis boy have been prevented and are justice and compensation available to the young victim?

Local News

Security measures are in question after a 15-year-old boy was shot outside of the “Hickory Forest apartments” Thursday morning, October 4, 2018, according to WREG 3.  A man reportedly opened fire on a “group of teens” in the complex parking lot. The young victim fled to a Burger King with a “gunshot wound to the arm.”

The complex was apparently the location of a shooting and home invasion in July, per WREG reports.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this unconscionable shooting may have been prevented.

  • Have there been prior incidents of violence on or near property? What security measures, such as gated-entry, bright lighting, fencing, surveillance cameras, and security patrols, were in place to deter crime and protect the victims at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the property owner or management failed to provide adequate security to protect those on its premises, the young victim may seek justice and elect to pursue legal claims for his injuries.

(WREG 3)

Memphis apartment owners have a responsibility to protect their residents from violent crime, sexual assault, and foreseeable harm. Unfortunately, owners all too often fail to implement and/or maintain critical security measures, leaving residents and their guests vulnerable.

On August 21, WREG 3 reports, “gunfire erupted at…Apartments off Alcy, injuring six people including a pregnant woman.” Tenants reportedly told media the “apartment complex is plagued with violence.”

The subject complex was apparently listed as one of the “top 19 apartments for crime” in July 2017, according to WMC Action News 5 reports, with an alleged 71 calls to Memphis police over a 90 day period.  “Apartments on Kingsgate Drive topped the list with 141 calls” over the same period.

Victims of Apartment Violence: Know Your Rights

Memphis apartment residents have a right to feel safe and secure in their homes and to protect their families and guests. By law, apartment owners are required to protect all residents and their guests from any foreseeable harm. Should an apartment complex owner fail in this critical responsibility, they may be held civilly liable for any sexual assaults, injuries or wrongful deaths which occur as a consequence.

Could this unconscionable sexual assault have been prevented and is justice available to the young victim?

Elsa Velasquez bravely fought off an alleged child predator at a Memphis apartment complex Thursday evening, June 7, 2018, rescuing her 3-year-old daughter. In a community all too often silenced through fear, Ms. Velasquez spoke out to protect her child and other families.

According to News 3, the 3-year-old victim was playing with her cousin in the apartment complex courtyard when a man “grabbed her by the hand and pulled her across the parking lot to a wooded area.”

Ms. Velasquez was able to find the suspect and pull him off her daughter by the hair. After he fled, WVLT 8 reports, she courageously tracked him down and reported him to police, so he couldn’t harm any other children.

Did a security failure contribute to this Memphis apartment shooting?

A pregnant woman was reportedly shot and injured inside her home at the Legacy at the Parkway apartment complex in Memphis Thursday, April 26, 2018.

According to FOX 13, the violent home invasion occurred around 6:00 a.m. at the Legacy at the Parkway Apartments in Hickory Hill. A female suspect apparently “kicked open the door” and shot the pregnant victim multiple times before fleeing with her cellphone. The victim told police she “started knocking on doors and screaming for help, but nobody answered.” She eventually “ran a mile to a friend’s apartment” to call 911.

    (Spotcrime.com May 2018 Crime Map)

Recent crime reports from Spotcrime.com reveal a staggering number of assaults in the surrounding area. Was the apartment complex owner aware of local criminal activity? If so, what additional security precautions, such as gated-entry, surveillance cameras and security patrols, were implemented to deter crime and protect residents?

  • Media reports indicate the victim could not find help inside her own apartment complex and had to run a mile to call 911. Where was apartment staff and security during this critical time? Did the delayed response cause any further harm to the victim or her unborn child?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm.
